1. Overview
ChatSphere builds and deploys AI voice bots that answer phone calls, book appointments, respond to customer questions, and provide automated support when your team is unavailable. We use third-party platforms such as Retell AI, Vapi, and others to deliver this service. You may choose to manage the bot under your own account or request that we manage it on your behalf.
2. Client Accounts & Ownership
We deploy bots under client-owned accounts when possible. When we build your AI voice agent, you retain full ownership and control of your accounts and data. If we manage an account on your behalf, you may request access or transfer ownership at any time. All call data, recordings, and transcripts are stored on your own accounts — ChatSphere does not store, copy, or sell any of your data.
3. Data & Privacy
Your privacy and your customers’ privacy are important to us.
Data storage: We do not retain any customer call data on our servers. All voice and message logs are stored through third-party platforms (e.g., Retell AI) under your account.
Management: If we manage your bot, we access your data only to configure and support your voice agent, and only on a need-to-know basis.
Consent: You are solely responsible for compliance with call recording laws, including obtaining any required consent from callers.
Data requests: You may request that we delete or transfer any access we hold to your data or accounts.

4. Payments
You agree to pay all applicable fees for services provided by ChatSphere.
All payments are due as agreed prior to project launch or monthly service commencement.
Payments are non-refundable unless explicitly stated otherwise.
We reserve the right to suspend service for non-payment.
Third-party software costs (e.g., Retell AI usage fees) are separate and must be paid directly to the platform provider.
5. Acceptable Use
You agree not to use ChatSphere services:
In violation of any law or regulation
To record or share sensitive data without consent
To harass, defraud, or mislead callers
To harm or interfere with third-party platforms used to deliver services
Violation of this policy may result in immediate termination of services.
6. Third-Party Tools
ChatSphere relies on external platforms (like Retell AI, Vapi, Calendly, CRMs, etc.) to build and power your AI agents. These tools are subject to their own terms of service. ChatSphere is not responsible for downtime, policy changes, outages, or pricing changes on these platforms.
7. Intellectual Property
All ChatSphere-developed bot scripts, configurations, and workflows are provided for use under your business unless otherwise agreed. You may not copy, resell, or redistribute ChatSphere’s proprietary templates or services without our written consent.
8. Disclaimers & Limitation of Liability
Our services are provided “as-is” and “as available.” We do not guarantee that bots will be error-free, uninterrupted, or generate specific business outcomes. ChatSphere is not liable for:
Loss of revenue, business, or data
Legal issues resulting from improper use or call recording violations
Service interruptions caused by third-party platforms
In all cases, our total liability shall not exceed the fees paid by you to ChatSphere in the past 3 months.
9. Termination
You may terminate service at any time. We may suspend or terminate service if:
You breach these Terms
Your payment fails
You misuse the platform or violate applicable laws
Upon termination, any account access or bot management on our side will be revoked.
10. Updates to Terms
We may modify these Terms at any time. Updated versions will be posted to www.thechatsphere.com, and continued use of the service indicates your acceptance of any changes.
